The Gaetz Sex Trafficking Investigation Ended Without Charges. Then Trump Nominated Him Attorney General.

For roughly three years, the Department of Justice investigated Representative Matt Gaetz of Florida on allegations that included sex trafficking of a minor and paying for sex. In 2023, the DOJ closed the investigation without filing charges. In November 2024, Donald Trump nominated Gaetz to serve as Attorney General of the United States — the nation's top law enforcement officer. Gaetz withdrew his nomination three days later, after the House Ethics Committee released a report detailing its findings against him.

The Gaetz investigation began in earnest in 2021, when the DOJ opened a probe that included allegations of sex trafficking of a 17-year-old girl and paying for sex with multiple women. The investigation was connected to a broader probe into Gaetz's associate Joel Greenberg, a Florida county tax collector who pleaded guilty to sex trafficking of a minor and other charges in 2021. Greenberg's cooperation with federal prosecutors was central to the investigation of Gaetz.

What the Investigation Covered.

According to extensive reporting by the New York Times, Politico, and others based on sources familiar with the investigation, federal investigators examined whether Gaetz had sex with a 17-year-old girl who had been recruited by Greenberg, whether Gaetz had paid for sex with multiple women, and whether Gaetz had used drugs with those women. Investigators also examined whether Gaetz had used congressional resources improperly. Gaetz denied all allegations throughout, calling them a political hit and accusing a former DOJ official of attempting to extort him — claims that led to a separate investigation that ended without charges against anyone.

Joel Greenberg, whose cooperation was considered critical to any potential case against Gaetz, pleaded guilty to six felony counts including sex trafficking of a child. His sentencing was delayed repeatedly as prosecutors assessed his cooperation value. When the DOJ ultimately closed the Gaetz investigation in 2023 without charges, the reasons were not officially stated. Greenberg's cooperation was described by prosecutors as less useful than anticipated. Gaetz declared total vindication.

The House Ethics Committee Report.

The House Ethics Committee had been conducting its own parallel investigation. When Trump nominated Gaetz as Attorney General on November 13, 2024, the committee was weeks away from releasing its findings. Gaetz resigned from Congress immediately upon his nomination — which had the effect of technically ending the Ethics Committee's jurisdiction over him. However, the committee voted to release its report anyway.

The report, released November 20, 2024, concluded that Gaetz "had sexual contact with a minor" and "paid for sex," findings based on witness testimony, financial records, and text messages reviewed by the committee. The report also found evidence of illicit drug use and described a pattern of conduct that included Gaetz using his position to obtain access to women and girls. Gaetz dismissed the report as a partisan attack. Three days after his nomination, he withdrew, citing the difficulty of the confirmation process. The report's release almost certainly accelerated that decision.

The Attorney General Nomination.

The nomination itself — regardless of the outcome — warrants examination. Trump nominated a man who had been under federal investigation for sex trafficking of a minor to be the chief law enforcement officer of the United States, the head of the Department of Justice, the person who oversees federal prosecutors nationwide. The vetting process that should precede cabinet nominations either did not occur or did not produce a recommendation against Gaetz. Trump made the nomination anyway. Senate Republican leadership expressed serious reservations. When Gaetz withdrew, Trump nominated Pam Bondi — a former Florida attorney general — in his place.

Gaetz has not been charged with any crime. The Ethics Committee's findings are civil in nature, not criminal. But the pattern documented — by federal investigators, by the Ethics Committee, by extensive investigative journalism — represents a sustained record of conduct allegations that did not prevent him from serving in Congress for eight years or from receiving a nomination to the highest law enforcement position in the country.
